“Statement of Claim!”

Four words that sounds so big, in actual fact if you look up statement & claim in the Thesaurus you get a different outlook…Statement (declaration, announcement, testimonial) Claim (maintain, declare, argue).

So…let’s say ‘Statement of Claim’ again….’Declaration of Maintaining’…’Announcement of Declare’….’Testimonial of Argument’….. OK, no one ever said you didn’t want to pay your creditor, you weren’t saying the debt was not yours and there was no argument that your creditor would never see a penny.  The fact is you just didn’t have available funds to pay the creditor at the time they wanted their money. So what does the creditor do; puts in an application to the court to have a Statement of Claim served on you…a summons.

Not long ago, one of my client’s Mr W had received a Statement of Claim from one of his major creditors. Mr W faxed it to me straight away; he was panicked and extremely upset he asked me what’s going to happen now? Legal action is commencing! I advised Mr W to calm down as we will action this immediately. This situation throws the slower process of negotiation out the window and we move into top gear without a second thought.

After several phone calls to get to that one person within the list of the creditors managers, it’s time to plea to the emotional side of the creditor, the human side and the side that needs to understand our clients financial situation and what happened in his life to get him there. They also need to hear that if they continue with legal action bankruptcy is more likely to take place and the creditor will receive zero cents in the dollar.

After a lengthy conversation and building a bridge between us and the creditor my clients account was settled at a reduced rate that same afternoon. Legal action ceased, Mr W was able to pay the debt over a period of time by instalments and the creditor was out of pocket for the cost of  the Statement of Claim!

Just another day at the office….
